Overview

This website is operated by A Man & His Cave Pty Ltd (ABN 63 645 839 881). In these Terms of Service (“Terms”), the words “we”, “us”, and “our” refer to A Man & His Cave. By visiting this site or purchasing from us, you engage our “Service” and agree to be bound by these Terms and the policies referenced in Section 4.

Please read these Terms carefully before using the site. If you do not agree to the Terms, you may not use this site or purchase from us.

We may update these Terms from time to time. The latest version is always available on this page. Continued use of the site after an update constitutes acceptance of the updated Terms.

Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).

 

 

1. Online Store Terms

  • By using this site, you confirm that you are at least the age of majority in your state or territory of residence, or that you have the consent of a parent or guardian for any minor dependents using the site.

  • You must not use our products or the site for any illegal or unauthorised purpose, including copyright infringement or breach of liquor laws.

  • We reserve the right to refuse service to anyone, at any time, in accordance with applicable laws, including consumer protection and anti-discrimination laws. Situations where we may decline to continue servicing or trading with a customer are set out in our Refund & Returns Policy, Section 8 (Fair Use and Customer Conduct).

 

 

2. Products and Pricing

  • Prices are subject to change without notice.

  • Product descriptions, imagery, and colour representations are provided in good faith but may vary slightly from the actual item.

  • We reserve the right to limit quantities per order, restrict sale of items to specific regions, and discontinue any product at any time without notice.

  • Where installation is offered (for example, pool tables), additional fees and conditions apply. Complex access (stairs, narrow entry, tight turns, etc.) may incur an additional cost, which will be discussed with the customer before fulfilment. Installation detail is set out in the Refund & Returns Policy (Section 4) and the Warranty Policy (Section 4).

 

 

3. Delivery

Delivery and fulfilment options include:

  • Home delivery

  • Depot delivery

  • Installation — available for certain product lines (for example, pool tables)

Customers are responsible for confirming safe access and providing accurate delivery details. Additional fees may apply where redelivery, specialised handling, or complex access is required.

Transit damage, loss, or theft is covered by Parcel Protect, which is automatically included on every order. Full claim process, evidence requirements, resolution paths, and ACL fallback are set out in the Refund & Returns Policy (Section 3.1).

 

 

4. Our Policies

The following policies form part of your agreement with A Man and His Cave. They are referenced throughout these Terms and should be read alongside them:

  • Refund & Returns Policy — change of mind, transit damage / loss / theft, faulty items, missing or incorrect items, pool table specifics, return logistics, refund timelines, and fair-use / customer-conduct terms

  • Warranty Policy — warranty periods, coverage, exclusions, and claim procedures by product category

  • Parcel Protect FAQs — customer-facing explanation of Parcel Protect coverage and claims process

  • Shipping Policy — delivery timeframes, zones, and arrangements

  • Privacy Policy — how we collect, use, store, and protect personal information

Where there is any inconsistency between these Terms and one of the policies listed above, the more customer-favourable provision applies. Nothing in these Terms or the referenced policies limits your rights under the Australian Consumer Law.

 

 

5. Alcohol Sales and Age Restrictions

We retail alcohol products under the following liquor licences:

  • NSW Liquor Licence Number: LIQP770018043

  • QLD Liquor Licence Number: 241930

You must be 18 or over to purchase or receive alcohol. By placing an order for an alcohol product, you confirm that you meet the legal drinking age in your jurisdiction. We may request identification on delivery to verify age compliance with liquor laws.

 

 

6. Third-Party Tools and Links

We may offer tools, services, or integrations operated by third parties (for example, finance providers, courier tracking, payment processors). Use of these tools is at your discretion and risk.

Links on our site may direct you to external sites that we do not control. We are not responsible for third-party content or any loss arising from your use of a third-party site or service. We recommend reviewing the third party’s own terms and privacy policy before use.

 

 

7. User-Generated Content

By submitting reviews, photos, comments, or other content to our site, you grant A Man and His Cave a royalty-free, non-exclusive, worldwide right to use, reproduce, publish, and display that content in connection with our business.

  • Content you submit must be your own or licensed to you for that use.

  • We may remove any content that is offensive, misleading, false, or that breaches intellectual property or privacy laws.

  • Personal information you provide in connection with submitted content is handled under our Privacy Policy.

 

 

8. Privacy

We collect customer information with consent and use it to fulfil orders, provide customer service, and — where you have opted in — for marketing. We do not sell your personal information.

  • Information provided as part of a Parcel Protect claim is handled under NTI Limited’s Privacy Policy, in accordance with the Privacy Act 1988 (Cth). See Refund & Returns Policy, Section 3.1, for the Parcel Protect claim process.

 

 

9. Liability and Indemnity

To the maximum extent permitted by law, A Man & His Cave Pty Ltd is not liable for:

  • Indirect or consequential loss

  • Delays or failures caused by third-party couriers or freight providers (cover for in-transit damage, loss, or theft is provided through Parcel Protect — see Refund & Returns Policy, Section 3.1)

  • Misuse, unauthorised modification, or improper installation of products (where installation was not performed by A Man and His Cave)

You agree to indemnify A Man & His Cave Pty Ltd against any claim or liability arising from your breach of these Terms or of any applicable law.

Nothing in this section limits your rights under the Australian Consumer Law or any other non-excludable statutory right.

 

 

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising under these Terms will be handled within the jurisdiction of New South Wales.
